CONSERVATION COMMISSION
Town of Monterey, Massachusetts

                                                                        
MEETING DATE: July 9, 2007
Present: Richard Andrus, Timothy Lovett, Judith Bach and David Dempsey
The meeting convened at 6:13p.m.

Alpert 177 Mt Hunger Rd; continued from 5/07 meeting
This meeting was reopened and a summary was given by the representatives.  They commenced today with the wall removal, GeoTech has a licensed engineer onsite.  Rebuilding of the wall will not begin until the investigative work is completed.  The Building Commissioner is also being kept in the loop.  The updated plans the commission requested at the last meeting were provided.  The pool and terrace have been eliminated from the building/site plans.  The new plans have not yet been sent to the Highway Department for driveway approval.  The representatives would like to deal with the wall, landscaping and house as separate issues.  The house will be divided into 3 main elements with connectors.  Landscaping plans were discussed.  A final set of plans is to be submitted by White Engineering before the amended order of conditions is issued.  A motion was made and seconded to approve the project as amended.

Kamenstein 18 Woodland Dr: Review revised plans and SMA Certificate of Compliance
New plans were reviewed; an amended order of conditions will need to be issued.  A certificate of compliance (SMA Form H) was issued.

Kelly/Nadler 535 Main Rd: no show

Melzer 35 Bidwell Rd SMA RDA & RDA
Commission made a site visit.  Okerstrom Lang was supposed to submit a letter to the Con Comm for this meeting; no letter received and no one showed.

Gelbard 19 Lime Rock Lane RDA
Marc from Foresight services, representative for the Gelbards presented the project.  The project was approved as submitted as an N5 with a 310 CMR 10.53(3)(i) exemption activity.  Marc was asked to call D. Dempsey when the silt fence was up.

Jackson Mt Hunger Rd SMARDA – SMA07-04: no show

Brown 24 Point Rd NOI 230-0238
Ann Bruzzi from Berkshire Engineering, representative for the Brown’s presented the project.  The Brown’s stated that the Building Inspector had ok’d the project from a zoning standpoint which the Commission wanted confirmed since the project was located in the 40foot no build zone and because the footprint was being increased.  Two letters of objection (dated 6/7/07 and 6/11/07) to the project were received by the board and read aloud from abutter Paul Gelbard of 22 Point Rd.  Mr. Gelbard was present and voiced his concerns/objections.  Comments from DEP were pretty standard.  The Browns also filed with the Natural Heritage which responded that the project was exempt.  Ann suggested getting a letter from the Building Inspector for the Conservation Commission.  This hearing was continued to the August meeting.

Camp 72 Tyringham Rd: Dock/Deck Repair/Rebuild
The plans to rebuild and repair his deck and dock were reviewed.  The dock was ruined over the winter.  After reviewing the plans, the Commission determined that a RDA should have been filed.  A letter will be sent to Mr. Camp (the building inspector will be cc’d) approving the request to repair the dock with a caveat that it is not a waiver of the RDA process and he is required to install a silt fence.  The Commission also noted that there is no allowance for an enlargement.  Any disturbance of the bank area of the resource will constitute non-compliance and trigger a response.

USPS 444 Main Rd
Information requested by the Commission at a previous meeting was provided.  A letter will be written that the information was received and the board is satisfied with the plans.

For Discussion:
1.      Mail was reviewed.
2.      Additional documents received from the State for the Mandelbaum property was reviewed.
3.      An Emergency Order was written for the Town to go onto Richard Tryon’s property to clear fallen trees out of Rawson Brook.
4.      The board reviewed a procedure for dock repairs and will work on this at their next meeting.
